Compassionate Representation When Negligence Takes a Life

There is no preparing for the loss of someone you love, and there are no words that make it lighter. When that loss is the result of another person’s or company’s negligence, the grief is compounded by anger, by unanswered questions, and often by sudden financial pressure that arrives at the worst possible moment. Funeral costs, lost income, and medical bills from a loved one’s final care fall on a family already struggling to absorb the unthinkable.

A wrongful death claim cannot undo what happened, and we would never suggest otherwise. What it can do is two things that matter. It can hold the responsible party accountable, which many families find is an essential part of being able to move forward. And it can provide the financial security your loved one would have wanted for the people they left behind. Pursuing that claim should never add to your burden, which is why we handle every part of the process ourselves and treat each family with the care and respect this moment demands.

The Law Offices of Ali A. Ajrouch, PLLC brings more than twelve years of personal injury and litigation experience to these cases. We manage the legal and procedural requirements, conduct the investigation, deal with the insurers, and guide your family through Michigan’s wrongful death and probate process, so that you can focus on each other and on healing. When you are ready, the conversation is private and there is no obligation.

When Negligence Becomes Fatal

A wrongful death claim can arise from nearly any situation where someone’s negligence or wrongful act causes a death that otherwise would not have occurred. The most common circumstances we handle include the following.

Fatal Auto and Truck Crashes

Collisions caused by speeding, distracted, impaired, or reckless drivers, and crashes involving commercial trucks and carriers, are among the leading causes of wrongful death. These cases combine Michigan No-Fault rules with traditional liability law.

Medical Negligence

Preventable deaths caused by misdiagnosis, surgical error, medication mistakes, or failure to treat a serious condition. These claims carry the same demanding procedural requirements as other malpractice cases, including expert affidavits.

Dangerous Premises

Fatal falls, drownings in inadequately secured pools, and deaths caused by other hazards on negligently maintained property can give rise to a wrongful death claim against the property owner.

Defective Products

Deaths caused by unsafe consumer products, defective vehicles or parts, dangerous machinery, or failed safety equipment may support a product liability wrongful death claim against the manufacturer.

Who Can File a Wrongful Death Claim in Michigan

Michigan’s Wrongful Death Act sets out specific rules about who may bring a claim and how any recovery is shared. Understanding this structure helps families know what to expect.

Under Michigan law, a wrongful death claim must be brought by the personal representative of the deceased person’s estate, not directly by individual family members. The personal representative is appointed through the probate court, and one of the first things we do is help the family establish the estate and obtain that appointment so the claim can move forward. Any compensation recovered is then distributed to the surviving family members entitled under the statute — which can include a spouse, children, parents, and other close relatives — according to their losses, subject to probate court approval.

How We Guide Your Family Through the Process

From the first conversation to the resolution of the claim, we handle the steps that would otherwise fall on your family during an impossible time.

1. Establish the estate

2. Investigate liability

3. Pursue full recovery

4. Obtain probate approval

We fight to recover compensation for funeral expenses, lost income, and the emotional impact of your loss, all while treating your case with the care and respect it deserves.

The Law Recognizes More Than Lost Income

A wrongful death affects every part of a family’s life.

While financial losses matter, Michigan law also recognizes the personal losses surviving family members experience every day.

Those losses may include:

FAQ

Wrongful Death Questions, Answered

Who can file a wrongful death claim in Michigan?

Under Michigan’s Wrongful Death Act, the claim must be brought by the personal representative of the deceased person’s estate, who is appointed through probate court. We help the family open the estate and obtain that appointment. The recovery is then distributed among the surviving family members entitled under the statute, such as a spouse, children, and parents.

Recovery can include the deceased’s final medical expenses, funeral and burial costs, conscious pain and suffering before death, the loss of financial support the deceased would have provided, and the surviving family’s loss of companionship, society, guidance, and comfort. The specific damages depend on the circumstances and the relationships involved.

Wrongful death claims are generally governed by the statute of limitations that would have applied to the underlying claim, often three years for negligence. However, malpractice-based claims and claims against governmental entities carry different and frequently shorter deadlines. Because the analysis is fact-specific, it is important to speak with an attorney early.

That is completely understandable, and there is no pressure. A brief, private conversation costs nothing and does not commit you to anything. It simply gives you the information you need — including any deadlines that may apply — so that you can make a decision on your own timeline rather than having it made for you by a deadline you did not know about.

Fatal car and truck accidents, medical malpractice, dangerous or defective premises, defective products, and other acts of negligence can all give rise to a wrongful death claim. If you believe another party’s carelessness contributed to your loved one’s death, it is worth discussing the circumstances with us.

Many wrongful death cases resolve through settlement, but we prepare every case for trial, and that preparation strengthens the family’s position. Separately, because the claim runs through the deceased’s estate, the probate court must approve any settlement and its distribution. We guide your family through that process from start to finish.

Nothing upfront. We handle wrongful death cases on a contingency-fee basis and advance the costs of the case. We are paid only if we recover compensation for your family, and if we do not, you owe no attorney fee.
